GDPR

General Data Protection Regulation

The GDPR is the EU’s data protection law, and the UK GDPR is the UK’s version. It defines valid consent: freely given, specific, informed and unambiguous. The ePrivacy rules (PECR in the UK) require that consent before a non-essential cookie is set, although since February 2026 the UK exempts some low-risk cookies.

Opt-in

Region
European Union and United Kingdom
Status
Applies since May 2018
Penalties
Up to €20 million or 4% of worldwide annual turnover, whichever is higher; under the UK GDPR, £17.5 million or 4%, a cap that has also applied to UK cookie breaches since February 2026. France’s regulator, the CNIL, fined Google €150 million in January 2022 because refusing cookies took more clicks than accepting them.
Who it affects
Organisations established in the EU or UK, and organisations elsewhere that offer goods or services to people in the EU or UK or monitor their behaviour there, for example with tracking cookies.

What the GDPR requires

  • Obtain opt-in consent, given by a clear affirmative action, before setting non-essential cookies (the UK now exempts some low-risk cookies).
  • Provide clear information about what each cookie does and who receives the data.
  • Make it as easy to withdraw consent as it was to give it.
  • Keep a record of every consent so you can prove it was obtained lawfully.
  • Allow users to change their consent preferences at any time.
  • Avoid dark patterns that nudge users towards accepting all cookies.

What the banner does here

Blocks non-essential cookies until the visitor chooses, with Reject all beside Accept all at the same size, and no pre-ticked boxes.

How GrantCookie covers it

  • Scheduled scans. The scanner finds the cookies and trackers your site sets, sorts them into categories and re-checks on every scheduled scan, so the banner asks about what is really there.
  • Provable records. Every choice is timestamped and stored with the banner version the visitor saw. Paid plans include consent log export.
  • Withdrawing consent. A re-open control stays on every page, so visitors can withdraw or change their choice at any time.
The consent log: each row has a timestamp in UTC, a consent ID and the visitor’s choice
